Congratulations on registering as a user of the application “KEC International Forwarding” operated by Kaili Electronics Supply Chain Solutions (Shenzhen) Co., Ltd. (hereinafter referred to as “we” or “us”). This app/mini-program is referred to as “this platform.”

To protect your legal rights, please carefully read and fully understand the terms of this agreement before selecting and signing it. If you have any questions about the agreement, you may consult our customer service. By clicking the authorization login as indicated on the page, it means that you have read, understood, and accepted all the content of this agreement. If you disagree with this agreement or any of its provisions during the reading process, you should immediately stop logging in.

1. Login and Usage

User Qualifications: You confirm that before you start using the services of this platform, you have the legal civil capacity stipulated by the laws of the People’s Republic of China and the civil capacity appropriate to your behavior.

Account Explanation: Your first login will synchronize the registration account. Upon completing the authorization login as guided on the page, you can obtain the corresponding account and become a user of our platform. If your account remains inactive for a long time, we reserve the right to carry out cancellation and other clearance operations, after which your account will no longer be able to log in and related services will be terminated. We will notify you of the clearance through platform announcements, messages, or SMS in advance.

Truthfulness and Legality: When using the platform’s services, you understand and agree that you have the obligation to ensure the truthfulness and validity of the information you provide. You are not allowed to act on behalf of others or impersonate others. Otherwise, we have the right to refuse your use of this platform and pursue relevant legal liabilities. You are prohibited from using this platform for illegal activities including but not limited to money laundering and fraud. If we reasonably suspect you have engaged in such illegal or non-compliant acts, we have the right to suspend or terminate your service provision and adopt other legitimate risk control measures.

2. Privacy Policy

KEC International Forwarding endeavors to protect the personal information provided by the sender. It ensures that the collection, use, processing, retention, disclosure, transmission, security, and storage of personal information comply with legal regulations and the relevant service rules issued by KEC International Forwarding. The sender guarantees that all personal data provided are lawfully obtained and has obtained consent from the recipient to provide it to KEC International Forwarding and its cooperating third-party logistics channels.

3. Platform Usage Rules

The product and price, specification, and other information displayed on this platform are provided for your browsing and reference only. When you place an order, you must confirm the specific contents such as product quantity, price, and payment method. The system will automatically generate an order according to the information you confirm, and you may submit the order after successful reservation.

In case of system failure or platform downtime causing unreasonable product information display (including but not limited to product prices being significantly underestimated), please do not proceed with further operations and notify platform customer service for correction immediately. If you knowingly submit an order with obviously unreasonable information, it may be considered improper conduct and the platform has the right to cancel the order.

You must ensure honesty and credit during transactions using this platform. In the process of paying for transactions, you may be invited to review the purchase information of products including single price, purchase quantity, discounts, and payment methods. Please carefully verify and confirm these details. The order form stored on this platform server constitutes your proof of each transaction’s receipt, delivery, and dispute items. By clicking “Submit Order” and “Pay Shipping Fee” you mean you acknowledge that all information contained in the order form is accurate, legal, and complete. You must bear legal responsibility for any above-mentioned acts during the use of the platform’s services.

4. Provided Services

4.1 Cargo Inspection Photo Service

We provide senders with cargo inspection photography services. To use this service, the sender must first dispatch the cargo to KEC International Forwarding’s designated warehouse located within Mainland China through express delivery. Before handing over the cargo for forwarding, the sender must confirm the accuracy of the number, color, size, etc., of the goods. After the sender’s goods reach the KEC International Forwarding domestic warehouse, we will take multiple high-resolution inspection photos free of charge for the sender to confirm the quantity, color, and size of the goods before forwarding, reducing the chance of receiving damaged or incorrect goods. Unless the sender specifically requests otherwise, we generally take photos and inspect the packing according to the express box/bag while preserving the form of goods inside the packaging. We refuse to dismantle the inner packaging and directly touch the goods. If it involves confidential items, senders may make special notes, and we will inspect according to the requirements.

Due to international logistics needing to pass through customs between two countries, the unpacking and inspection process is mandatory. If during inspection, we find any goods that do not comply with international postal standards, we will immediately contact the sender and assist in handling the goods, such as returning the goods to the sender’s designated domestic address.

Disclaimer: The return shipping fee due to non-compliance with international postal standards shall be borne by the sender. If the sender hides goods that do not comply with such standards during shipment and conceals or partially conceals the facts from us, all types of direct or indirect losses, damages, and related liabilities arising shall be solely borne by the sender.

4.2 Warehousing Service

We provide 180 days of free warehousing services for goods delivered to KEC International Forwarding’s domestic warehouse (counting from the day of arrival, including the day of arrival). Within 3 working days after the goods are delivered to the warehouse, we will inspect, photograph, and shelve the goods.

Senders must provide proprietary cargo information through the [KEC International Forwarding] mini-program (including sender membership ID) or add the express order number in the mini-program so that the express is assigned to the sender’s KEC International Forwarding member ID account. If warehousing exceeds 180 days, we have the right to charge the sender an overtime storage fee, calculated at 1 RMB per domestic express package per day, with a maximum overtime storage period of 180 days.

Disclaimer: If express packages stored in KEC domestic warehouses exceed 180 days, resulting in overtime storage fees, and the sender refuses to pay or disputes the fee, or if no one adds the express in the [KEC International Forwarding] mini-program within 180 days, making it impossible to determine the corresponding ownership and rights to the express, the packs may be handled accordingly. Upon expiration of the 180-day storage period, KEC reserves the right to take disposal measures for these packages, and the sender or accounts related to the packages are deemed to have tacitly acknowledged KEC’s method of disposal and cannot raise objections.

4.3 Packing Service

When the sender applies for packing services for goods in the warehouse, KEC International Forwarding will take downrelated express from the shelves for packing services, including free weight reduction and repacking services. During packing, we will photograph the goods in the packaging and upload them to the [KEC International Forwarding] mini-program to let the sender verify the quantity and type of goods. The sender should raise disputes within 24 hours after receiving the packing photos. If no dispute is raised within the period, the packed contents are deemed undisputed, and we do not take responsibility for subsequent issues regarding quantities or types of goods.

Due to labor and time costs involved in the packing process, if the sender requests to add or reduce items in the completed packing, an additional handling fee of 30 RMB per time will be charged to the sender, payable once before the packing service application. If multiple packings are required due to sender reasons, the fee applies every time.

Disclaimer: During the ordering process for the KEC International Forwarding service, the sender must notify KEC International Forwarding in advance if the cargo to be dispatched has special packing needs such as irregular shape, fragility, or susceptibility to damage. If the sender fails to notify in advance, and KEC discovers such special needs during inspection and packing, we will notify the sender of the risks involved. If the sender still decides to dispatch, we will consolidate the package before international logistics dispatch. However, because the exact conditions of international logistics cannot be predicted, if damage or breakage occurs after the recipient receives the goods, KEC International Forwarding does not assume any liability.

4.4 International Logistics Transport

After dispatching the goods from the KEC International Forwarding domestic warehouse, the cargo will be transported internationally through KEC’s self-operated logistics channels or third-party cooperating logistics channels, and ultimately delivered to the overseas destination designated by the recipient. During the entire transportation process, the goods will go through domestic transport, China customs inspection, flight scheduling, international shipping, destination country customs, and final delivery, among other multiple procedures. The insurance services we provide vary depending on the logistics routes of different countries. Upon the recipient accepting KEC International Forwarding’s services, it means tacit agreement to all rules of KEC International Forwarding logistics.

Due to effects like flight delays and customs deductions, KEC International Forwarding cannot predict in advance or guarantee immediate dispatch of your packages on any flight, nor can we prevent customs officials from suddenly accelerating the inspection of your packages. What we can do is continuous inquiry, intervention, and pressure. If time delays, lost or untraceable items result, KEC International Forwarding assumes corresponding liability according to the rules for the relevant route.

Disclaimer: Due to weather, natural disasters, politics, social unrest, war, transportation route interruption/stoppage, and customs inspections that cannot be resisted, causing delays or exceeding delivery deadlines or quality/repair deadlines, the sender tacitly agrees that KEC International Forwarding is not liable for any cargo damage. From the start of service, the sender agrees to handle everything in accordance with KEC International Forwarding’s related rules and accepts the results fully.

As this shipping method is not cold chain transport and international logistics involves multiple steps and complexities, KEC International Forwarding cannot guarantee delivery within the reference effective period for perishable food or short shelf-life items or homemade food. KEC International Forwarding does not assume any liability for expired food or any food safety issues arising therefrom. Please carefully consider sending such food and accept all resulting responsibilities.

4.5 Customs Clearance Services

KEC International Forwarding offers sender the option between tax-free passage and non-tax-free passage on different routes. For customs tax generated during clearance, the tax on tax-free routes will be entirely borne by KEC International Forwarding, while the tax on non-tax-free routes is the responsibility of the sender or recipient. We will assist senders or recipients in customs clearance and coordinate promptly if special documents, information, or other conditions arise during clearance.

Disclaimer: Customs deductions are government actions, and KEC International Forwarding cannot guarantee that such events will not occur. From the moment the sender or recipient accepts KEC International Forwarding services, it is tacitly agreed that KEC International Forwarding will handle according to related rules and fully accept the results of clearance.

4.6 Final Delivery

Due to different national conditions, delivery services vary significantly across countries, possibly lacking SMS or phone notifications, requiring secondary delivery payment, or self-pickup. KEC International Forwarding will notify the sender or recipient in advance through the system or manual notice. If there is any package damage, loss, or shortage after the recipient receives the package, the recipient must contact us immediately.

Disclaimer: If the recipient fails to receive the package timely leading to return or loss, incorrect completion of address or postal code by the sender, address changes during transportation, or other situations causing delivery failure or loss for reasons attributable to the sender or recipient, the sender agreeing to use KEC International Forwarding services tacitly agrees that KEC International Forwarding is not liable.

5. Liability Standards

5.1 Air Transport

5.1.1 Definitions and Interpretations
  • Loss: Refers to the loss of order exceeding the air transport reference standard effective period of 15 days, including but not limited to loss within warehouse, airport loss, or customs clearance loss. (Losses caused by terminal dispatch personnel, political factors, natural disasters, etc. are not within the compensation scope.)
  • Delay: Refers to delay exceeding the air transport reference standard effective period of 15 days (including), resulting in delayed orders. (Losses caused by terminal dispatch personnel, political factors, natural disasters, etc. are not within the compensation scope.)
  • Damage: Refers to damaged packaging or internal goods collected within the normal effective period by customers, including appearances like perfectly intact packaging but internal breakage or deformation. (Losses caused by terminal dispatch personnel, political factors, natural disasters, etc. are not within the compensation scope.)
5.1.2 Liability Standards

<Time-limited Air Transport>

  • Loss / Deduction: ① If the loss/deduction is not reported online: refund of shipping fee, compensated according to actual loss (with transaction screenshot including order number), maximum twice the shipping fee, max 1200 RMB; ② If reported online: no shipping fee refund, compensated according to actual loss (with transaction screenshot including order number), maximum twice the shipping fee, max 1200 RMB.
  • Delay: ① Delay ≤ 10 days: compensation 4 RMB/kg, additional compensation 2 RMB/kg per day beyond, single ticket capped at 10 RMB/kg (with issued coupon); ② Delay > 10 days: considered loss, no shipping fee refund, compensated according to actual loss (with transaction screenshot including order number), maximum twice the shipping fee. (Excludes prohibited goods)

<Standard Air Transport>

  • Loss / Deduction: ① If the loss/deduction is not reported online: refund of shipping fee, compensated according to actual loss (with transaction screenshot including order number), maximum twice the shipping fee, max 1200 RMB; ② If reported online: no shipping fee refund, compensated according to actual loss (with transaction screenshot including order number), maximum twice the shipping fee, max 1200 RMB.

5.2 Sea Transport and Card Shipping

5.2.1 Liability Standards
  • Loss / Deduction: ① Before overseas pickup loss/deduction: refund of shipping fee, compensated according to 20 RMB/KG, maximum 3 times the shipping fee; ② After overseas pickup loss: no shipping fee refund or compensation.
  • Undelivered Items After Signing: The official website shows signed delivery, but the recipient refuses and does not receive the goods. Within 10 days from the signing date shown on the official site, inquiries can be made; beyond 10 days, no inquiry will be accepted. The company can assist in applying for inquiry overseas but will not handle any compensation claims.
  • Damage to Packaging and Loss of Contents: The company can assist in applying for investigation but does not assume responsibility for damaged packaging or loss of contents; customers should package fragile items carefully.
5.2.2 Additional Notes
  1. Due to natural disasters (e.g., typhoons, earthquakes, floods, hail), government actions (e.g., requisition or conscription), and social emergencies (e.g., strikes, riots), loss or interruption caused by uncontrollable factors are not compensated.
  2. If the loss or interruption is caused by customer’s original reasons (such as smuggling or leakage), it is outside compensation scope; the company assists in clearance but does not bear responsibility for customs duties.
  3. Customers placing orders should verify the delivery address information. If the provided information is incorrect causing any costs or consequences, customers bear responsibility.
  4. Compensation amount is deducted before continuing transportation charges.

6. KEC International Forwarding Liability

KEC International Forwarding’s liability regarding the shipped goods shall be based on this agreement, related regulations of the logistics routes used by the goods, and the insurance agreements (such as sender’s free insurance service or purchased insurance) concluded. Each shipment can only claim compensation once, and all loss or damage related to the shipped goods shall be considered complete and final. Shippers, recipients, or other related rights holders shall not make repeated claims.

From the start of using KEC International Forwarding services, senders fully and tacitly agree to the relevant regulations and compensation standards set by KEC International Forwarding and recognize all losses and compensations are finally and irrevocably decided by KEC International Forwarding. The sender, recipient, or related rights holders shall not dispute.

7. Force Majeure

KEC International Forwarding is not liable for any loss or damage caused by conditions beyond its control, including but not limited to:

  1. Acts of government agencies exercising actual or apparent authority, acts by persons not contractors or employees of KEC International Forwarding (including senders, recipients, customs, government departments, or third parties) concerning safety, security regulations, or other applicable regulations at payment points.
  2. Wars, riots, strikes, labor shortages, civil commotions, epidemics or illnesses, communication and information system faults or interruptions (including but not limited to KEC International Forwarding’s communication and information systems), and air or ground traffic network interruptions or interference including electromagnetic damage to electronic images, audio, data, or records.
  3. Natural disasters including but not limited to earthquakes, hurricanes, typhoons, floods, etc. Once senders begin to use KEC International Forwarding services, they tacitly agree that KEC International Forwarding is not liable for any liability arising from such circumstances.

One party experiencing a force majeure event shall notify the other within 24 hours and provide relevant proof documents within 15 days.

8. Dispute Resolution

The validity, interpretation, amendments, execution, and dispute resolution of this agreement shall all be governed by the laws of the People’s Republic of China. In the event of a dispute arising during the implementation of this agreement, we will negotiate with you for resolution. If negotiation fails, both parties may apply to the Consumers’ Committee or other legally established mediation organizations. If mediation fails, both parties agree to submit to the People’s Court in Futian District, Shenzhen City for judgment. During mediation, the unaffected terms of this agreement shall still be implemented.

9. Termination of Agreement

Unless we terminate this agreement or you request termination and we agree, this agreement remains valid. If you violate the terms of this agreement or we encounter exemption conditions under this agreement, we have the right to terminate this agreement or restrict your use of our services without prior notice.

10. Others

If some provisions of this agreement are deemed invalid or unenforceable, other provisions remain effective. For any disputes regarding this agreement’s content, both parties may resolve through supplementary agreement or other means.

You agree to the validity and evidentiary power of electronic data. Records, electronic data, and documents created, stored, or maintained by us, including electronic and paper documents, vouchers, and logs, constitute valid evidence concerning rights and obligations between both parties.

The content of this agreement includes related agreements of this platform and service rules which may be continuously published. Upon official publication, they form an indivisible part of this agreement, and you must comply accordingly.
